Home / Deceased estate shares
Selling shares from a loved one’s estate, with a clear path and a real person to call.
For executors and the solicitors who help them. Gather the documents, complete one online form, and the proceeds are paid into an estate or executor account, or a solicitor’s trust account.
Opens the live One Off Trades share sale form. On the form, choose “Deceased Estate” when asked how the shares are held.
In short: the holding must be registered to the estate (or to the executor with the estate as an account designation), the executor provides probate (or the Will, death certificate and a small estate indemnity form), and funds go only to an estate or executor bank account, or a solicitor’s trust account.
The steps for an executor
Get the death certificate
Obtain a certified copy. It is needed for legal and administrative purposes.
Confirm whether probate is needed
If the deceased was the sole holder, probate or letters of administration are generally required.
Apply for probate if required
Once granted, the executor has authority to deal with the estate’s assets, including shares.
Value the shares and consider tax
The CGT cost base depends on when and how the deceased acquired the shares. Ask a tax professional to confirm it before selling.
Sell the shares with One Off Trades
No broker needed. Complete the online form and executor ID check.
Distribute the proceeds
Pay beneficiaries under the Will or intestacy rules and keep records for the final estate accounts.

Deceased estate questions
Is probate needed to sell shares from a deceased estate?
It depends on how the shares were held. If they were held jointly, the surviving holder generally becomes the sole owner and probate is not required. If the deceased was the only holder, probate or letters of administration are generally required. If probate has not been issued, One Off Trades asks for the death certificate, the Will and a small estate indemnity form, which it provides when you apply.
Whose name must the shares be registered in?
The holding must be registered in the name of the estate, for example Estate of John Doe, or in the executor's name with the estate as an account designation. If it is not, the executor must ask the share registry to update it first.
Where does the money go?
Funds can only be paid into a bank account in the name of the estate or an executor, or into a solicitor's trust account.
What does it cost to sell estate shares?
Nothing is charged upfront. On the Value Service the fee is 1.045% including GST (0.95% plus GST), with a minimum of $115.50 including GST ($105 plus GST), plus a deceased estate surcharge of $50 or 0.5% (whichever is greater) plus GST. For a $7,390 holding that comes to $170.50 including GST, leaving estimated proceeds of $7,219.50.
Are there tax implications?
Capital gains tax can apply to shares in an estate. The rules depend on when the shares were acquired and how long they were held, so speak to a tax professional before selling.
What if my number starts with X?
A HIN starting with X means your shares are broker sponsored. Ask the broker about selling, or call us about transferring the holding.
What if the shares are jointly held and one holder has died?
For joint SRN holdings with a deceased holder, contact One Off Trades on (02) 8999 0595 for assistance.
